In 2023, TSSA began rolling out a Rule Making Framework to structure how TSSA reviews, assesses and implements updates made by standard-writing bodies to relevant codes and standards through revisions to TSSA Code Adoption Documents in order to enhance public safety in a synchronized way. This will affect the way changes are considered for scheduled code reviews in the future. For example, TSSA will be better able to keep pace with codes and standards development via more timely adoption of new codes. The Rule Making Framework is intended to reduce the potential for conflict of various rules and processes and to increase transparency for stakeholders who are required to follow them. TSSA will continue to consult publicly, including with the Ministry of Environment, Conservation and Parks, on all changes to fuel codes. TSSA did not adopt any new fuel-related codes in 2023.

The ministry reviewed and considered the policy. The Technical Standards and Safety Authority (TSSA), the Ministry of Public and business Service Delivery (MPBSD), and the ministry continue to work together to meet the intent of applicable policies set out in Source Protection Plans to protect Ontario’s drinking water sources. This includes but is not limited to developing educational materials and amending regulatory instruments such as the Liquid Fuels Handling Code and the Fuel Oil Code. The ministry will continue to report on the actions resulting from the review of the policy. MPBSD’s policy response (4.7.5 NB) states that the TSSA has adopted the latest edition (2019 editions) of CSA B139 series codes under O. Reg. 213/01 which apply to fuel oil storage and handling. TSSA has communicated the new code requirements to affected stakeholders through a variety of channels. Since adopting the code, TSSA has been administering it. The code helps protect the environment from existing, new or proposed storage tank systems that contain petroleum products.
Policy Text:
Where the handling and storage of fuel at facilities defined in Section 1 of Ontario Regulation 213/01 or Section 1 of Ontario Regulation 217/01 is or would be a drinking water threat, the Ministry of Consumer Services and the Ministry of the Environment should consider source water protection during the next scheduled code review in part by considering changes such as the use of fuel handling and storage equipment (i.e. supply tanks, supply lines, etc.) that research has shown to be resistant to leaks.
The Ministry of the Environment and the Ministry of Consumer Services should include information about this policy in an annual summary of actions taken to achieve the outcomes of source protection policies and make it available to the Cataraqui Source Protection Authority.
