Town has updated its Site Alteration By-law (No. 17-0040) to require a separate application for large scale/commercial site alteration activities, including the alteration of the grade, the placing, dumping of fill in or from a site, or the removal of topsoil from a site, where the volume of fill involved is greater than 5,000 cubic metres (m3). The Halton Region Federation of Agriculture was notified for comment (no comments received) and a public meeting was held at Council prior to the by-law being amended. Town staff will consider through upcoming OP review whether this can be brought into existing SP policy framework.

New Excess Soil Regulations were implemented. Council approved in 2019 a comprehensive Site alteration By-law to regulate site alteration on lands within the City of Hamilton and minimize adverse impacts on infrastructure, environment and community in respect of site alteration undertakings and to promote and protect agricultural resources (https://www.hamilton.ca/sites/default/files/2022-05/19-286.pdf)

Oakville does not really have a rural component. Transportation and Engineering staff require contractors and developers to comply with regulations regarding proper disposal of fill and town operations are conducted in compliance with existing provincial regulations and guidelines.

Policy Text:
The municipalities and the Halton Region and Hamilton Region Conservation Authorities are requested to develop and implement an education and outreach program for rural landowners, contractors, and developers based on Ministry of the Environment, Conservation and Parks guidance to best protect drinking water sources during the disposal or use of excess fill/soil including but not limited to contaminated soil.
