During development application review, Niagara communicates to applicants that private wells that are no longer used should be abandoned in accordance with O. Reg. 903, however this is not a condition of approval for development at the upper tier level. Niagara staff requested conditions of approval and/or recommended that the local municipalities include a condition (e.g. consent) requiring former wells to be properly abandoned in accordance with the regulation. A majority of development applications are in the urban area and, therefore, already on municipal water.

The Region of Peel’s Servicing Connections team reviews applicant proposed servicing drawings. Servicing approvals requires that a note to decommission private well on property is on the approved site servicing drawing, where applicable.

Policy Text:
To achieve the intent of the Clean Water Act, 2006, that drinking water threats identified in the vicinity of a transport pathway cease to be or do not become a significant threat, and that a pathway ceases to endanger the source water of a municipal water supply, the following policies apply:
b. Municipalities are requested to incorporate conditions of approval for development applications to ensure private wells that are no longer in use are decommissioned in accordance with Ontario Regulation 903.
