The City of Brantford Official Plan was amended to include reference to the Source Protection Plan, policies and reference mapping in 2021, which partially satisfied the Source Protection Plan’s Policy CB-MC-1.3. In 2022-2023, we were members of the New Zoning Bylaw Project Working Group, as the zoning bylaw is in the process of being evaluated and amended. The new Zoning Bylaw that will include Source Water Protection mapping, as well as language that development applications are subject to applicable Source Water Protection policies is currently scheduled for public consultation on Jan. 29, 2024. It is anticipated that the bylaw will be formally adopted in 2024.
Policy Text:
The City shall amend its Official Plan and respective Zoning By-Laws to:
- Identify the vulnerable areas in which drinking water threats prescribed under the Clean Water Act, 2006 would be significant;
- Indicate that within the areas identified, any use or activity that is, or would be, a significant drinking water threat is required to conform with all applicable Source Protection Plan policies and, as such, may be prohibited, restricted or otherwise regulated by the Source Protection Plan policies; and
- Incorporate any other amendments required to conform with the threat specific land use policies identified in this Source Protection Plan.
Monitoring Text:
CB-CW-1.7: Where the City is required to amend their Official Plan and/or Zoning By-law to bring their planning documents into conformity with the Source Protection Plan, the City shall provide proof of compliance to the Source Protection Authority and shall provide a copy of such compliance within 30 days of the amendments coming into effect or, where the matter has been appealed to the Ontario Municipal Board, the date of their decision to approve.
