Upper Tier and Lower Tier Municipalities are circulated on all new aggregate licence applications. Any comments/concerns relating to the application must be resolved by the proponent within two years of the application being circulated. If the municipality has unresolved objections to the application at the end of the two year notification and consultation period the MNRF may refer the licence application to the Ontario Land Tribunal for a hearing.

When a prescribed instrument (existing or future) is found to have activities that are significant drinking water threats, OMAFRA contacts the Risk Management Official to provide information on the prescribed instrument and to discuss potential management measures to be added to the prescribed instrument. When a condition is added to a prescribed instrument the Risk Management Official is copied on the accompanying cover letter and approval document.

MECP – Pesticides

No pesticide permits that are Prescribed Instruments have been issued in this SPA. All pesticide permits undergo a site and pesticide specific evaluation by the ministry's Regional Pesticides Specialists. Conditions are placed on all issued pesticide permits, as required to mitigate potential risks. Additionally, Ontario has a strong and robust legislative and regulatory framework for the sale, use, storage and disposal of pesticides.

If an approved activity is deemed a significant drinking water threat, the ministry will review the activity and the ECA to determine if changes are needed to meet the intent of the source protection policies. The ministry addresses drinking water threat activities that are regulated by ministry approvals and permits on a consistent province-wide basis. Please also refer to responses by the Ministry of Natural Resources and Forestry, Ministry of Transportation, Ministry of Agriculture, Food and Rural Affairs to policy 1.24 for further details.

MTO - Fuel

There were no existing or proposed prescribed instrument applications affected by source protection policies. All (existing and future) MTO Aggregate/Wayside Permits, as well as existing dormant Permits activated for a provincial highway contract, must contain fuel handling and storage conditions in the site plan, as prescribed by regulation. This includes installation of fuel storage tanks in accordance with the CSA B139 Installation Code for Oil Burning Equipment and compliance with the strict conditions specified by the Technical Standards and Safety Authority (TSSA) Liquid Fuels Handling Code, 2017, as amended. Furthermore, MTO does not allow permanent or long term storage of fuel at MTO permit sites. Such requirements ensure the activity is managed in a manner that reduces the risk of contamination. In accordance with the mandatory requirements of the AROS, all new Aggregate and Wayside Permit applications must be circulated to the Upper and Lower Tier Municipality for review and comment. The Ministry of the Environment, Conservation and Parks is copied on those Permit applications that require the completion of a Level 2 Water Report. Feedback provided back to MTO is considered in the application review and approvals process.

Policy Text:

The Ministry of Environment, Conservation and Parks, the Ministry of Agriculture, Food and Rural Affairs and the Ministry of Natural Resources, for Prescribed Instruments for significant drinking water threats within vulnerable areas, shall advise the Townships regarding applications under review and that the Townships be provided an opportunity to provide comments on these applications. The relevant Ministry shall have due regard to the comments submitted by the Townships.
