Based on criteria, the prescribed instrument application may be flagged for a more detailed ‘secondary screening’ to determine if the activity associated with the application is a significant drinking water threat. If yes, the appropriate standard operating policy is applied. As legally required, where a source protection policy that relies on a prescribed instrument to prohibit an activity that is a significant drinking water threat, the ministry is conforming to the policy by refusing to issue an instrument for the activity.

Following the approval of the new Official Plan in fall 2021, the City has initiated the process of updating zoning by-laws to conform to Source Protection Policies. This will include prohibition of sewer works as listed in policies SEW-9-LB-PA/PI-MC and SEW-15-LB-PA/PI-MC. Source Protection Regions will be consulted on zoning by-law amendments; new zoning by-laws are expected to be drafted in 2024. Currently, new development applications are screened through an internal Section 59 screening process.

Policy Text:
Future sewage works of the types listed in policy SEW-13-LB-PI-MC are prohibited where they would be a significant drinking water threat as described in Appendix B. Accordingly, decisions to issue, otherwise create or amend Prescribed Instruments (Environmental Compliance Approvals under the Ontario Water Resources Act) must conform with this policy. In addition, decisions made by planning authorities under the Planning Act must conform with this policy.

MON-2-LB Annual Report from the Municipality — Legally Binding Policies
By February 1 of each year, the municipality shall provide the Source Protection Authority with a summary of implementation activities for the previous calendar year related to legally binding policies where the municipality is the implementer.
MON-7-LB Annual Report from the MOE — Legally Binding Policies
By February 1 of each year, the MOE shall provide the Source Protection Authority with a summary of implementation activities for the previous calendar year related to significant/moderate/low threat policies where the MOE is the implementer.
