Ministry staff have completed the review and screening process to identify previously issued Environmental Compliance Approvals for sewage works located in vulnerable areas where prescribed instrument policies may apply with the initial source protection plan approvals. However, the ministry continues to identify and review new existing Environmental Compliance Approvals as a result of source protection plan amendments on an annual basis. For those existing instruments that were screened by the Ministry and subject to existing threat prescribed instrument policies, the existing instruments had been reviewed to determine if the Standard Operating Policy can be applied or if amendments are needed to protect municipal drinking water sources.
Policy Text:
Where an existing sewage works is a significant drinking water threat as described in Appendix B, the MOE shall ensure that the Prescribed Instrument (Certificate of Approval or Environmental Compliance Approval required under the Ontario Water Resources Act) that governs the sewage works includes appropriate terms and conditions to ensure that it ceases to be a significant drinking water threat. This policy applies where the types of sewage works include:
Sewage treatment plant effluent discharges
Industrial effluent discharges
Storage of sewage (excluding storage associated with the sewer network)
Combined sewer discharge from a stormwater outlet to surface water
Sewage treatment plant bypass discharge to surface water
The MOE shall review and amend the Prescribed Instrument within three years from the date the Source Protection Plan takes effect.

By February 1 of each year, the MOE shall provide the Source Protection Authority with a summary of implementation activities for the previous calendar year related to significant/moderate/low threat policies where the MOE is the implementer.
