In January 2025, TSSA conducted a 60-day public consultation on an updated version of the 2021 Fuel Oil CAD. Source water protection is addressed in the Fuel Oil CAD through general requirements for the use of certified equipment and appliances. This consultation was posted on the Environmental Registry. Significant changes were made to this version of the Fuel Oil CAD in the form of incorporation of Part 3 of the former TSSA Field Approval Code into the Fuel Oil CAD, resulting in a second condensed 30-day consultation, which was also posted on the Environmental Registry. TSSA continues to maintain information on tank safety on its website.

The ministry has reviewed and considered the policy. The Technical Standards and Safety Authority (TSSA), the Ministry of Public and Business Service Delivery and Procurement (MPBSDP), and the ministry continue to work together to meet the intent of applicable policies set out in Source Protection Plans to protect Ontario’s drinking water sources. This includes, but is not limited to, amending regulatory instruments such as the Liquid Fuels Handling Code and the Fuel Oil Code. The ministry will continue to report on the actions resulting from the review of the policy. TSSA consulted stakeholders on proposed amendments to the Fuel Oil CAD in 2025.
Policy Text:
Where the handling and storage of fuel at a facility as defined in Section 1 of Ontario Regulation 213/01 is or would be a significant drinking water threat as described in Appendix B, the Ministry of Consumer Services and the Ministry of the Environment are strongly encouraged to consider source water protection during the next scheduled code review.
In addition, the TSSA is strongly encouraged to continue to include information regarding new code requirements and leak resistant technology in its communications products and request fuel suppliers to:
Promote to their customers the importance of regular maintenance as described in Section 13 of the Ontario Installation Code for Oil-burning Equipment to increase awareness of and compliance with this requirement (this could be accomplished by printing a reminder on the fuel bill)
Implementing bodies should see Section 5 for corresponding monitoring policies which could contain reporting requirements.

MON-12-LB Recommendations to the TSSA and the Ministry of Consumer Services
The Source Protection Authority will communicate annually with the MOE and/or TSSA and/or the Ministry of Consumer Services to:
• Obtain an update on progress related to the recommendations outlined in policy FUEL-3-NLB
• Obtain information about changes to legislation or programs that would impact policy FUEL-4-NLB
• Identify opportunities to partner on consistent messaging to the fuel sector.
