As per the Ministry's Standard Operating Policy on Sewage Environmental Compliance Approvals (EBR Registry No. 012-2968), the review and approvals processes for sewage environmental compliance approvals are adequate to manage activities which are moderate to low drinking water threats. Therefore, for aquaculture activities that are moderate or low drinking water threats, no additional terms and conditions beyond the existing approval requirements are needed in order to have regard to source protection prescribed instrument policies. Permits to Take Water rely on other instruments to manage discharges from aquaculture sites and include conditions directing the permit holder to obtain and comply with those approvals. Any Permit to Take Water issued for aquaculture complies with this policy.

The ministry continues to identify and review existing Environmental Compliance Approvals as a result of source protection plan amendments on an annual basis. For those existing instruments that are screened by the Ministry and subject to existing threat prescribed instrument policies, the existing instruments will be reviewed to determine if the Standard Operating Policy can be applied or if amendments are needed to protect municipal drinking water sources.

Where a source protection plan policy outcome is to manage a significant threat to drinking water sources through the prescribed instrument for sewage works, the ministry is meeting the policy’s obligations by including design and operational measures in an Environmental Compliance Approval. To assist in the implementation of this approach, anyone subject to policy requiring management of a significant drinking water threat is required to include in their application a description of the measures necessary to protect drinking water and submit a ‘Source Protection Supplementary Report’ to outline how the activity for the sewage works will be managed so that the activity will not become a significant drinking water threat.

Where the use of land or water for aquaculture (existing and/or future) is or would be a moderate drinking water threat as described in Appendix B and requires a Prescribed Instruments (Certificate of Approval or Environmental Compliance Approval or Permit to Take Water under the Ontario Water Resources Act), the MOE shall ensure:
a) Amendments to an existing instrument includes appropriate terms and conditions that address the threat and protect drinking water sources; or
b) The future instrument includes appropriate terms and conditions that address and threat and protect drinking water sources.

By February 1 of each year, the MOE shall provide the Source Protection Authority with a summary of implementation activities for the previous calendar year related to significant/moderate/low threat policies where the MOE is the implementer.
