As per the monitoring report submitted to the Niagara source protection authority in February 2016, MTO has implemented policies WL-3 and DC-10. MTO distributed the emergency notification protocol and accompanying maps to MTO field staff. The emergency notification protocol was also included in the Niagara/Hamilton Contractor Directed Maintenance Contract as a mandatory requirement with which the Contractor must comply.

Spill response and notification procedures have been updated to geo-spatially determine if the spill is in a source protection vulnerable area. These new procedures ensure that if a spill has the potential to impact a drinking water treatment plant, the plant is notified along with any other affected parties. Please also refer to policy WL-3 of the Ministry of Transportation’s annual report for further details.
Policy Text:
St. Lawrence Seaway Management Corporation (SLSMC), Ontario Ministry of Environment (MOE) Spills Action Centre (SAC), and Ontario Ministry of Transportation (MTO) are requested to update their Emergency Response Plans (ERPs) to include the following where applicable:
Maps that show the locations of the Welland Water Treatment Plant intake and its associated IPZ-3 and IPZ-1.
An up-to-date communications protocol showing the structure of command of the various agencies that would be contacted.
As it relates to railway corridors, Transport Canada is requested to ensure Emergency Response Plans under their jurisdiction are updated accordingly.
The ERP shall be updated within two years from the time the Source Protection Plan comes into effect.
Monitoring Text:
M1: By February 1st of each year, the Ontario Ministry of the Environment (MOE) shall report to the Source Protection Authority on the steps it has taken in the previous calendar year to implement significant threat policies.
M9: By February 1st of each year, Niagara Peninsula Conservation Authority shall report to the Source Protection Authority with a description of the steps St. Lawrence Seaway Management Corporation and Transport Canada have taken to implement significant threat policies during the previous calendar year.
M11: By February 1st of each year, the Ontario Ministry of Transportation shall report to the Source Protection Authority on the steps it has taken in the previous calendar year to implement the significant threat policies.
