Policy 1.08 Restricted Land Uses for Event-based Modeled Threats (the Section 59 Restricted land use policy) in the TSR Source Protection is implemented by the Essex Region RMO. A written direction is in place for municipal staff at the Municipality of Lakeshore, Municipality of Leamington, and the Municipality of Chatham - Kent to ensure handling and storage of fuel activities within drinking water intake protection zones and Event Based Areas are flagged during the planning and building process for RMO review. Municipal staff are offered refresher training on an annual basis or as needed by Risk Management staff to ensure the written direction is being followed and that activities are being screened. The RMO works directly with municipal staff during the review process and business operators and or landowners to manage fuel activities that are considered a SDWT activity with the completion of a site specific Risk Management Plans.

Policy Text:
To reduce the risk to municipal drinking water sources from the handling and storage of fuel, in event modelled quantities, this activity shall be managed where it is or would be a significant drinking water threat.
This activity shall be designated for the purposes of Section 58 of the Clean Water Act and a Risk Management Plan shall be required. This policy shall apply to event modelled quantities in event based areas where modelling has identified the activity as a significant drinking water threat. The Risk Management Official must be satisfied that the Risk Management Plan will adequately manage the activity so that it ceases to be or never becomes a significant drinking water threat. Where, in the opinion of the Risk Management Official, a future expansion of a facility handling or storing fuel is of such size that it cannot be managed, the Risk Management Plan may restrict the size so that the activity ceases to be or never becomes a significant drinking water threat.
The Risk Management Plan may include but is not limited to:
details concerning how to contain fuel;
the location of fuel;
how fuel is stored.
This policy shall not apply to the storage of fuel for use in back-up generators for Water Works.

5.10: The Risk Management Official shall provide a report to the Source
Protection Authority, by February 1 of each year, summarizing the actions
taken by the Risk Management Official and the Risk Management
Inspector(s). The information that shall be contained in this report is
outlined within Sec. 65 (1) of O. Reg. 287/07.
