Policy Text:
Where the handling and storage of fuel is or would be a significant drinking water threat for activities regulated under the Aggregate Resources Act within vulnerable areas, the Ministry of Natural Resources, shall review prescribed instruments to ensure that licenses, permits and site plans issued under the Aggregate Resources Act and related regulations, standards and policies include terms and conditions, as appropriate, to ensure the activity does not become or ceases to be a significant drinking water threat.
The Ministry of Natural Resources shall ensure that permits issued refer to the requirements of the Technical Standards and Safety Act liquid fuel handling code. This may include, but is not limited to, details concerning installation and operation of fuel storage tanks, how fuel is contained, the location of fuel tanks, how fuel is stored, and disposal details for both unused fuel and/or tank replacement.
Applicable Areas:
Fuel tanks of between 250 and 2,500 litres or greater than 2500 litres capacity:
- WHPA A and B (vulnerability score of 10) – Deloro, Madoc, Peats Point, Point Anne and Tweed
Fuel tanks larger than 2,500 litres capacity:
- IPZ 1 and 2 (vulnerability score of 9 or greater) – Ameliasburgh (IPZ 1), Belleville (IPZ 1), Deseronto (IPZ 1), Napanee (IPZ 1), Picton (IPZ 1 and 2), and Point Anne (IPZ 1).
Effective Date:
When the Plan, or any plan amendment, as applicable, takes effect for future activities and within two years for existing activities.
