In existing Wellhead Protection Areas and Intake Protection Zones municipalities should note that Ontario Regulation 287/07 (under the Clean Water Act) contains a notification requirement pertaining to new transport pathways.

If a person applies to a municipality for approval to engage in an activity in a Wellhead Protection Area or Intake Protection Zone that may result in the creation of a new, or modification of an existing transport pathway, Municipalities are required under subsection 27(3) of Ontario Regulation 287/07 to:

1) Provide notice of the proposal to the Source Protection Authority and Source Protection Committee;

2) Ensure the notice includes a description of the proposal, the identity and contact information of the person responsible for the proposal, a description of the approvals the person requires to engage in the proposed activity, and any municipal comments related to source protection; and

3) Provide a copy of this notice to the person responsible for the proposal.

Effective Date
When the Plan, or any plan amendment, as applicable, takes effect and in accordance to subsection 27(3) of Ontario Regulation 287/07.

Monitoring Text:

Each municipality should prepare a report for the Quinte Source Protection Authority by February 1st of each year summarizing how this policy was implemented and the number of Transport Pathways that have been proposed and approved during the previous calendar year.
